Please read these Terms & Conditions carefully. By downloading, installing, or using The Purse mobile application on iOS or Android, you agree to be bound by these terms. If you do not agree, do not use the App.
By accessing and using The Purse ("App"), you accept and agree to be bound by these Terms & Conditions. The Purse ("we," "us," or "our") operates this App. The App is free to download and use. If you do not agree to these terms, please do not use the App.
Permission is granted to download and use one copy of the App on a device you own or control, for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:
To use The Purse, you must create an account using Sign in with Apple on iOS or Google Sign-In on Android. You are responsible for:
You must be at least 18 years old, or the age of majority where you live, to use The Purse.
You may only create one account per person. Creating multiple accounts to gain an unfair advantage is prohibited and will result in account termination.
You agree not to engage in any of the following prohibited conduct:
We reserve the right to investigate suspected violations and may suspend or terminate your account if you violate these terms.
The Purse tracks picks, standings, and results. It is free to use. The App does not offer, facilitate, or take part in wagering of any kind, and it does not set, collect, hold, process, transfer, or pay out any money.
A group organizer may choose to display a message about an entry fee and a payment handle (for example a Venmo username) to the members of that group. That information is displayed for the members' own reference. Any entry fee or other arrangement between group members is made directly between those members, outside the App, by whatever method they choose. The Purse is not a party to those arrangements, does not process or receive any payment, and has no way of knowing whether any such arrangement exists or has been honored.
You are solely responsible for any arrangement you enter into with other members, including whether it is permitted where you live, and for any taxes or other obligations that may arise from it. The Purse does not provide tax reporting or withholding and does not handle refunds or disputes over such arrangements.
All content in The Purse, including its logo, graphics, text, and software, is the property of The Purse and is protected by copyright and other intellectual property laws.
By submitting content to the App (a display name, profile photo, group name, or announcement), you grant us a non-exclusive, royalty-free license to display that content to the members of your groups and to use it to operate the App. You must have the right to submit any content you provide.
Tournament schedules, fields, leaderboards, and prize money are sourced from publicly available ESPN and PGA Tour data and are used to compute standings within the App. You may not extract, scrape, or republish this data from the App.
Tournament and organization names and logos shown in the App, including those of the Masters Tournament, the PGA Championship, the U.S. Open, The Open Championship, THE PLAYERS Championship, the WM Phoenix Open, the FedEx Cup, and the PGA Tour, are trademarks of their respective owners and are used to identify the events being scored. The Purse is an independent app and is not affiliated with, sponsored by, or endorsed by the PGA Tour, Augusta National Golf Club, the PGA of America, the USGA, The R&A, FedEx, ESPN, or any tournament, tour, or broadcaster.
The Purse is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses, or that leaderboard data will be timely or accurate.
The Purse is not responsible for:
In no event shall The Purse's total liability to you exceed the amount you have paid to The Purse in the past 12 months, or $100, whichever is less.
Disputes between members (entry fees, arrangements between members, picks, and the like) are the responsibility of those members to resolve. The Purse does not arbitrate disputes between members.
We will investigate reported scoring errors or data discrepancies. Decisions made by The Purse regarding scoring corrections are final. Disputes must be reported within 7 days of the alleged error.
If you believe your account has been wrongfully terminated or suspended, contact us at ahunter916@gmail.com with documentation of your claim. We will review and respond within 7 business days.
You agree to indemnify and hold harmless The Purse, its owners, and operators from any claims, damages, or costs arising from:
We may terminate or suspend your account immediately, without prior notice or liability, if you:
You may delete your account at any time in the App under Settings → Delete Account. Deletion is immediate and permanent. Results from events you have already played remain part of your groups' historical standings, as described in our Privacy Policy.
Upon termination, your right to use the App ceases immediately. Any arrangements between you and other members are unaffected by, and will not be resolved by, The Purse.
The App is distributed through the Apple App Store and Google Play. Apple and Google are not parties to these Terms, are not responsible for the App or its content, and have no obligation to provide maintenance or support for it. To the extent the App Store's or Google Play's own terms apply to your download, those terms govern your relationship with Apple or Google.
We may modify these Terms & Conditions at any time. Changes become effective when posted at this address. Your continued use of The Purse after modifications indicates your acceptance of the updated terms. If you do not accept the changes, you must stop using the App.
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict-of-law rules. You agree that any dispute arising from these Terms or the App will be brought in the state or federal courts located in Idaho, and you submit to the jurisdiction of those courts.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, and all other provisions shall remain in full force and effect.
These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and The Purse regarding the use of the App and supersede all prior agreements.
